SOBRE A OBRA "Festejamos a publicação deste livro "Responsabilidade civil e direitos fundamentais", precisamente a décima segunda obra coletiva empreendida pelo IBERC (Instituto Brasileiro de Estudos de Responsabilidade Civil), graças ao empenho de seu conjunto de associados, nacionais e internacionais, estudiosos e divulgadores da temática, em toda sua transdisciplinaridade. A par do elogiável conteúdo dos 26 artigos aqui reunidos – tendo como fio condutor a atualidade da tutela aos direitos humanos e situações existenciais por meio da responsabilidade civil – há um dado subjacente, igualmente "fundamental" e inspirador desta publicação. A obra aborda a capacidade civil das pessoas com deficiência mental nos cartórios para a prática de atos existenciais. Busca responder à indagação: após a revisão da teoria das capacidades civis, promovida pelo Estatuto da Pessoa com Deficiência (Lei n.o 13.146/2015), e a afirmação de que a deficiência não afeta a plena capacidade civil das pessoas (art. 6o), quais são as hipóteses lícitas de recusa à prática do ato por elas pretendido nas serventias de notas e registros? An important part of the book is a thorough, article by article account of the guarantee in the American Declaration of the Rights and Duties of Man and in the American Convention on Human Rights of civil, political, economic, social and cultural rights in the light of the jurisprudence of the Inter-American Commission on Human Rights and the Inter-American Court of Human Rights, and of the Commission's many country reports on the human rights situation in particular states. There are also chapters on the rights of indigenous peoples, amnesty laws and states of emergencies. The evolution and current methods of work of the Commission and the Court are set out at length and their achievements are critically assessed.
