A separação de questões políticas em diversas agendas internacionais fragmentadas levou à falaciosa crença de que o Direito Internacional Público também deveria ser fracionado em múltiplos sistemas jurídicos autorreguláveis. Contudo, desde o soerguimento dessa ideia de um Direito Internacional Público segmentado, cada vez em maior escala, evidências concretas vêm provando haver permeabilidade entre as normas que compõem esses múltiplos sistemas jurídicos internacionais. Justamente nesse sentido, partindo da noção contemporânea de que o Direito Internacional encontra nos direitos humanos o seu fator estruturante, o presente trabalho investiga o impacto do sistema jurídico internacional de proteção aos direitos humanos no sistema jurídico internacional de proteção aos investimentos, tomando como objeto de estudo a arbitragem de investimento.
Comitê Brasileiro de Arbitragem e a Arbitragem no Brasil
Embora promulgada em 1996, a ratificação da constitucionalidade de alguns dos dispositivos da Lei de Arbitragem apenas se deu em 2001. Naquele ano, surgia o Comitê Brasileiro de Arbitragem ("CBAr"), cujo propósito é desenvolver a cultura arbitral e difundir, em termos acadêmicos e práticos, a arbitragem no Brasil. A história da arbitragem no Brasil se confunde com a do CBAr e, para celebrar o 20o aniversário da instituição, a presente obra lança a reflexão sobre a história do futuro da arbitragem.
